Deconstructing the Probate Process
Probate is the legal process that guides the administration of an estate. If an individual passes away without a will, the probate court appoints an executor to distribute the deceased’s assets in accordance with the law. If there is a will, its validity must be proven in court. Additionally, the probate court oversees the distribution of assets and payment of debts under and outside of the will.
Some assets are not subject to probate, including trusts and jointly owned property. We can assess the estate to determine which assets, if any, must go through probate.
