What Is Probate?

Probate is the legal process that guides the administration of an estate. If an individual passes away without a will, the probate court will appoint an executor, and that executor will distribute the assets in accordance with the law. If there is a will, the validity of the will must be proven to the probate court. Additionally, the court will oversee the distribution of assets and payment of debts under the will as well as certain assets and debts that fall outside of the will.

Not all assets are subject to the probate process. Trusts and jointly-owned property are examples of assets that fall outside of probate. We can help you assess the estate and determine what assets, if any, need to go through the probate process.
